Terms of Use
The agreement between you and us for using ATELITH

1. Acceptance of Terms

These Terms of Use ("Terms") govern your access to and use of ATELITH ARE Study (the iOS and web study companion for the Architect Registration Examination) together with atelith.com and any related services (collectively, the "Service"). The Service is operated by Hatch Media LLC ("ATELITH", "we", "us", "our").

By creating an account, signing in, downloading or installing the app, starting a free trial, or otherwise using the Service, you agree to these Terms. If you don't agree, please don't use the Service.

These Terms work alongside our Privacy Policy, which explains how we handle your data.

2. Eligibility

You must be at least 16 years old to use the Service, and at least 18 years old (or the age of majority in your jurisdiction) to enter into a subscription. By using the Service you represent that you meet these requirements.

3. Accounts and Sign-In

To use most features of the Service, you'll create an account or sign in with Apple. You are responsible for:

  • Providing accurate information when registering.
  • Keeping your credentials confidential and not sharing them.
  • All activity that happens under your account.
  • Notifying us promptly if you suspect unauthorized access at contact@atelithare.com.

We may suspend or terminate an account at any time if we have a good-faith reason to believe these Terms have been violated, or to protect the Service or other users.

4. Subscription & Billing
Applies to: ATELITH ARE Study iOS app and web companion

The ARE Study app is offered as an auto-renewable subscription billed through Apple's App Store. Your subscription unlocks content on both the iOS app and the web companion.

Monthly Plan
$29.99 USD per month, billed monthly through your Apple ID after a 7-day free trial.
Annual Plan
$149.99 USD per year, billed yearly through your Apple ID after a 7-day free trial.
Free Trial
New subscribers receive a 7-day free trial that begins at the time of subscription. To avoid being charged, you must cancel at least 24 hours before the trial ends.
Auto-Renewal
Subscriptions automatically renew at the same price unless you cancel at least 24 hours before the end of the current period. Renewal is charged to your Apple ID.
Cancellation
Manage and cancel anytime in Settings → Apple ID → Subscriptions on your iPhone, or at apps.apple.com/account/subscriptions. Cancellation takes effect at the end of the current billing period.
Refunds
Refunds are handled by Apple, not us. Request refunds at reportaproblem.apple.com. We are not able to issue refunds directly.

By starting a free trial or subscription you authorize Apple to charge your Apple ID per the terms above. All payment processing is handled by Apple. We never receive your card details.

5. Acceptable Use

You agree not to:

  • Use the Service to violate any law or regulation.
  • Reverse-engineer, decompile, or disassemble any part of the Service except where allowed by applicable law.
  • Attempt to gain unauthorized access to the Service, other accounts, or our infrastructure.
  • Scrape, redistribute, or republish content from the Service for commercial purposes without our written permission.
  • Resell, rent, or sublicense access to the Service.
  • Use automated means (bots, scrapers) to interact with the Service in ways that disrupt its operation.

The study content — flashcards, practice questions, mock exams, Field Guide, and AIA reference summaries — is licensed for your personal study only. You may not distribute, resell, or share account credentials.

6. Content Ownership

Our content stays ours. The Service itself — software, designs, text, study content, exam questions, Field Guide entries, brand marks, illustrations — is owned by ATELITH or its licensors and is protected by copyright, trademark, and other laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for its intended purposes during your active subscription.

7. ARE Study Disclaimers
Critical — read before using the ARE Study app

Unofficial study aid. ATELITH ARE Study is an unofficial study aid produced by ATELITH. It is not affiliated with, endorsed by, or sponsored by:

  • The National Council of Architectural Registration Boards (NCARB)
  • The American Institute of Architects (AIA)
  • Any state, provincial, or jurisdictional architecture licensing board

"ARE", "Architect Registration Examination", "NCARB", "AIA", and "AIA Contract Documents" are trademarks of their respective owners. References to AIA documents (e.g., A201, B101, G701) are summaries for educational discussion only, not authoritative reproductions, and are not a substitute for the actual documents.

No guarantee of exam outcomes. Using the app does not guarantee that you will pass any division of the ARE. Exam content, format, and weighting are determined by NCARB and change over time. Our content is our best effort to summarize the principles and reference material commonly tested, but it may be incomplete, outdated, or wrong on specific points.

Not professional advice. Content in the app — including questions, explanations, and Field Guide summaries — is for educational purposes only and does not constitute legal, architectural, engineering, financial, or other professional advice. Always consult licensed professionals and current authoritative sources.

8. Warranty Disclaimer
The Service is provided "as is" and "as available", without warranty of any kind, express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any errors will be corrected. We do not warrant any specific outcome from your use of the Service, including passing any examination.
9. Limitation of Liability
To the maximum extent permitted by law, in no event will ATELITH, Hatch Media LLC, or their officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, goodwill, professional reputation, exam results, or business opportunities, arising out of or relating to your use of the Service, whether based in contract, tort, statute, or any other legal theory, even if we have been advised of the possibility of such damages. Our total aggregate liability for any claim is limited to the amount you paid to us in the 12 months preceding the event giving rise to the claim, or fifty US dollars ($50), whichever is greater.

Some jurisdictions don't allow the exclusion of certain warranties or limitations on liability, so some of the above may not apply to you. Where required by law, our liability will be limited to the greatest extent permitted.

10. Indemnification

You agree to defend, indemnify, and hold harmless ATELITH and Hatch Media LLC and our officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service, (b) your violation of these Terms, or (c) your violation of any rights of another.

11. Termination

You may stop using the Service at any time. To cancel a subscription, see Section 4.

We may suspend or terminate your access to the Service at any time, with or without notice, if: you violate these Terms; we're required by law; or we discontinue the Service (or any portion of it).

Sections that by their nature should survive termination — including Content Ownership, Disclaimers, Warranty Disclaimer, Limitation of Liability, Indemnification, and Governing Law — will survive.

12. Changes to These Terms

If we make material changes to these Terms, we'll notify you by email or by an in-app notice at least 30 days before the change takes effect. Continuing to use the Service after that time means you accept the updated Terms. Minor changes will be reflected in the "Last Updated" date at the top of this page.

13. Governing Law and Disputes

These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-law principles. Any dispute arising out of or related to the Service or these Terms will be resolved exclusively in the state or federal courts located in Palm Beach County, Florida, and you consent to the jurisdiction of those courts.

If you're a consumer in the EU or UK, this section doesn't deprive you of the mandatory consumer protections of your home jurisdiction.

14. Apple App Store Terms

If you obtained our iOS app through the Apple App Store, you acknowledge and agree:

  • These Terms are between you and ATELITH, not Apple. Apple is not responsible for the app or its content.
  • Apple has no obligation to provide maintenance and support for the app.
  • In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, who will refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation.
  • Apple is not responsible for addressing any claims you have relating to the app, including product liability, consumer protection, or regulatory-conformance claims.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms with respect to your use of the app and have the right to enforce them against you.
15. Miscellaneous
  • Entire agreement. These Terms, together with the Privacy Policy and any other notices we publish, form the entire agreement between you and us regarding the Service.
  • Severability. If any provision is found unenforceable, the rest stays in effect.
  • No waiver. Our failure to enforce a term doesn't waive our right to do so later.
  • Assignment. You may not assign these Terms without our consent. We may assign them to an affiliate or in connection with a merger or acquisition.
  • Force majeure. Neither party is liable for delays caused by events beyond reasonable control.
